Privacy Policy

Last updated: Oct 27, 2026

Effective Date: 01 Dec 2026

This Privacy Policy explains how Caphyon S.R.L. (“Caphyon”, “we”, “us”, or “our”) collects, uses, shares, and protects Personal Data when You visit the Website or use the Advanced Web Ranking Service, and the rights You have in relation to that data. It applies alongside the Terms of Service, which govern Your use of the Service. Capitalized terms not defined in this Privacy Policy have the meaning given to them in the Terms of Service or, where not defined there, in the General Data Protection Regulation (EU) 2016/679 (“GDPR”).

If Your organization is an existing Enterprise customer with a signed custom contract or service level agreement (SLA) with Caphyon, the data protection terms of that contract prevail over this Privacy Policy to the extent of any conflict.

1. Who We Are and How to Contact Us

Caphyon S.R.L., Str. Ana Ipatescu Nr. 51, Dolj, Craiova, 200340, Romania, is the controller of the Personal Data described in this Privacy Policy.

For any question about this Privacy Policy or to exercise Your rights, contact us at legal@caphyon.com.

2. When We Are Controller and When We Are Processor

2.1 Data We Process as Controller. This Privacy Policy covers Personal Data that we process for our own purposes, namely data about:

  • visitors to the Website;

  • individuals who register for and administer Accounts, including billing and support contacts;

  • how Users access and use the Service (“Usage Data”, as described in Section 7.9 of the Terms of Service);

  • recipients of our marketing communications and individuals who contact us;

  • individuals whose Personal Data appears in publicly available information that we collect to provide the Service (“Public Data”, as described in Section 7.12 of the Terms of Service).

2.2 Data We Process on Behalf of Our Customers. Our customers may enter Personal Data into their Accounts as User Data, for example the email addresses of invited Users and report recipients, tracked keywords and prompts, or data obtained through External Connections such as Google Analytics or Google Search Console. For that data, the customer is the controller and we process it only on the customer’s behalf, as its processor, under the Data Processing Addendum. If You are an invited User, a report recipient, or otherwise have Personal Data in a customer’s Account, the customer’s own privacy notice applies, and You should address any request about that data to the customer. If You contact us instead, we will forward Your request to the customer where we can identify it.

3. Personal Data We Collect

3.1 Website Visitors. When You visit the Website, we and our analytics and advertising providers collect, through cookies and similar technologies and subject to Your choices as described in Section 11: browser and user agent, device type and operating system, referrer URL, IP address (shortened or anonymized where the tool supports it), and the pages You visit and how You interact with them. If You use the chat on the Website, we also collect the content of Your messages and any contact details You provide.

3.2 Registration and Account. When You register, we collect Your email address and password, which is stored only in encrypted form, together with any other details You provide, such as Your name and company name. We also keep Your Account settings and the Subscription You have chosen.

3.3 Orders and Payments. Subscriptions purchased online are sold by our authorized reseller, 2Checkout (Verifone) (“2Checkout”), which acts as merchant of record. 2Checkout collects Your name, email address, billing address, VAT or other tax identification number, and payment details, and processes them as an independent controller under its own Privacy Policy. We do not receive or store Your full payment card details. 2Checkout shares with us the order and billing information we need to activate and administer Your Subscription, such as Your name, email address, company, billing country, and the details of Your order. For customers with an Enterprise agreement whom we invoice directly, we process the billing contact details and invoicing data needed for that agreement.

3.4 Usage Data. When You use the Service, we collect technical and usage information, such as the time of access, IP address and the approximate location derived from it, device and browser information, the features You use and the actions You take, performance metrics, error logs, and security logs. From time to time, and subject to Your choices as described in Section 11, we may also record Your sessions in the Service, capturing the pages You view and Your clicks, scrolling, and other interactions, to diagnose problems and improve usability. Text You enter into input fields is masked and is not captured in these recordings.

3.5 Communications. When You contact our support team, reply to our emails, take part in surveys, or provide Feedback, we process the content of the communication and Your contact details. Support chat messages may first be answered by the AWR Chatbot, an AI assistant that sends Your message to a large language model provider to generate a reply. You can ask for a member of our support team at any time.

3.6 Public Data. To provide the Service, we collect publicly available information, such as search engine results pages, responses generated by AI platforms and large language models, and publicly accessible web content, for the keywords, prompts, and websites tracked by our customers. This information may incidentally contain Personal Data, such as the name of an individual mentioned in a search result or an AI response, or the author of a web page. We do not seek out Personal Data in Public Data and do not use it to build profiles of individuals. The sources of this data are the search engines, AI platforms, and public websites concerned.

3.7 Sensitive Data. We do not intentionally collect special categories of Personal Data under Article 9 of the GDPR, such as data revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic or biometric data, health data, or data about a person’s sex life or sexual orientation. As set out in Section 7.3 of the Terms of Service, customers must not submit such data to the Service.

3.8 Children. The Service is intended for business use by persons who are at least eighteen (18) years old. We do not knowingly collect Personal Data from children.

4. Purposes and Legal Bases

We process Personal Data for the following purposes and on the following legal bases under Article 6(1) of the GDPR:
